About this paper

The GDPR, the ePrivacy Directive, CCPA/CPRA and every cookie banner on earth exist because of what this industry does with personal data. This is the market that made consent a legal question, that carries the compliance cost of getting it wrong, and whose customers now ask about it in every procurement cycle.

It describes consent in its own APIs at 3.1% — against a whole-catalog rate of 3.3%. Thirty-nine companies out of 1,259, which is the same rate as companies with no personal data anywhere near them. Across 2,925 specification documents from the 244 best-published companies in this market, consent appears as a resource three times, and preferences and suppression not at all. There is a real explanation — consent lives in the browser, the banner, the TCF string and the customer contract rather than in the interface — and the report gives it in full before explaining why it stops holding the moment an agent is the one deciding.

The second finding is structural. The money side of this market publishes least. Advertising and programmatic is its largest segment — 360 companies — and its lowest-scoring, at 19.7, publishing a machine-readable contract 22.2% of the time, while the email and engagement tier averages 30.0 at 51.2% and voice-of-customer tools 32.2 at 52.2%. The closer a company sits to spending the budget, the less it publishes. That has a good historical reason and two reasons it is about to stop working, both of which are in the data.
